What is a land register?

Last updated: 18. June 2020 | Reading time: 1 minute

Land and rights equivalent to land (e.g. hereditary building rights) constitute a defined part of the earth’s surface (Section 905 of the German Civil Code (BGB)) and are registered in the land register.

The Land Register is an official, conditionally public register of land parcels, in which, for example, ownership details and, where applicable, rights attached to the land parcel as well as any encumbrances on it are recorded. Under Section 3 of the Land Register Act (GBO), each plot of land is assigned a specific entry (land register page) in the Land Register.

The land register page is to be regarded as the land register for the plot of land within the meaning of the Civil Code. All deeds and court records that have led to entries are archived in the land register file.
