Exclusive agency agreement with a estate agent

Last updated: 12. June 2020 | Reading time: 1 minute

Under German estate agency law, an exclusive agency agreement is a contract that defines an exclusive contractual relationship between an estate agent and the client. Under an exclusive agency agreement, the client commits to a single estate agent, who, in return, is obliged to provide a service.

A distinction is made between a ‘simple’ exclusive mandate and a ‘qualified’ exclusive mandate, under which not only are third-party estate agents excluded, but the owner is also prohibited from selling the property privately. Furthermore, an exclusive agency agreement usually sets out the terms of the offer, such as the asking price and commission.
